On March 1, 2023, proposed regulations were published in the Missouri Register. During the public comment period, which ran from March 1 to March 31, 2023, the agency received more than 800 comments from the public requesting revisions to the guidelines.

The Missouri Constitution’s Article XIV, Sections 1 and 2, may be enforced by rules issued by the Department of Health and Senior Services. The proposed rules will go into effect on July 30, 2023. These regulations may change until officially approved and published in the Missouri Register. The general provisions required for implementing Article XIV are described in this rule, which applies to all people and organizations governed by the article.

CSR 100-1.030 Complaints, Inspections, and Investigations:

The Department of Health and Senior Services is empowered by Missouri’s Constitution’s Article XIV, Sections 1 and 2, to establish regulations to safeguard the right to, availability of, and safe use of marijuana products. Licensed or certified facilities, licensees, and owners of identity cards are all covered in this section.

19 CSR 100-1.040 Consumers, Qualifying Patients, and Primary Caregivers:

Patients with qualifying medical conditions have the freedom to speak openly with their doctors about the potential advantages of using medical marijuana, as stated in Article XIV, Section 1 of the Missouri Constitution, as well as the right to use medical marijuana for treatment while being ethically supervised by a doctor or nurse practitioner. In addition, adults in Missouri at least 21 years old have the right to access marijuana under Article XIV, Section 2 of the Missouri Constitution. Following the same provision, the Department of Health and Senior Services ensures adult and patient access to marijuana, subject to reasonable limitations. This rule outlines the department’s strategy for implementing Article XIV’s practices regarding consumers, qualifying patients, and primary caregivers.

19 CSR 100-1.050 Physicians and Nurse Practitioners

According to Missouri’s Constitution’s Article XIV, Section 1, patients with qualifying medical conditions have the freedom to speak openly with their doctors and nurse practitioners about the potential advantages of using medical marijuana, and doctors and nurse practitioners also have the freedom to offer their professional opinions on the subject. This rule outlines the department’s approach to carrying out the provisions of Article XIV, Section 1, for doctors and nurse practitioners.

19 CSR 100-1.060 Facility Applications and Selection

Except for seed-to-sale tracking system entity applications, this regulation specifies how medical and marijuana facility licensing and certification requests are submitted and how the Department of Health and Senior Services chooses which licenses and certifications to grant.

19 CSR 100-1.070 Facility Ownership and Employment

To enforce Article XIV, Sections 1 and 2 of the Missouri Constitution, the Department of Health and Senior Services may enact regulations. Except for organizations that are part of a seed-to-sale monitoring system, this rule describes what general provisions are required for ownership and employment associated with authorized medical and marijuana establishments.

19 CSR 100-1.090 Cannabis Facility Security

Any property licensed or certified under Article XIV, Sections 1 and 2 of the Missouri Constitution may have security requirements established by the Department of Health and Senior Services.

The Department of Health and Senior Services is empowered to oversee and govern the activities of medical and marijuana facilities under Article XIV, Sections 1 and 2 of the Missouri Constitution. This rule describes the standard operating procedures for all licensed and certified facilities.

This rule details the packaging, labeling, and product design guidelines that apply to all licensees of medicinal and marijuana facilities.

19 CSR 100-1.140 Transportation and Storage

The Department of Health and Senior Services has the jurisdiction to regulate and manage the storage of, warehouses for, and transportation of marijuana products under Article XIV, Sections 1 and 2 of the Missouri Constitution. All licensees of medical and marijuana facilities who transport and store marijuana products are subject to the rules outlined in this rule.

19 CSR 100-1.150 Cannabis Waste Disposal

The Department of Health and Senior Services is empowered to oversee and govern the activities of medical and marijuana facilities under Article XIV, Sections 1 and 2 of the Missouri Constitution. Except for transportation facilities, this rule outlines how licensed and approved facilities shall eliminate any extra or useless marijuana trash, unwanted marijuana products, or any other garbage from the facility.

19 CSR 100-1.160 Cultivation Facilities

The Department of Health and Senior Services has the jurisdiction to monitor and regulate medical and marijuana facilities and licensees under Article XIV, Sections 1 and 2 of the Missouri Constitution. The rules for marijuana cultivation facilities are laid out in this rule.

The Department of Health and Senior Services has the jurisdiction to monitor and regulate marijuana microbusiness facilities and licensees under Article XIV, Section 2 of the Missouri Constitution. This rule details the laws that only apply to licensees and facilities for small businesses.
