Missouri Cannabis Licensing Requirements, Timelines, and Selection Processes

The DHSS awarded the first 192 dispensary licenses in January 2020. Up to 5 Missouri cannabis dispensary licenses, and/or 3 cultivation licenses, and/or 3 manufacturing licenses may be issued to “any entity under substantially common control, ownership, or management.” Product types include flower, edibles, tinctures, and oil. The Missouri cannabis application period has closed for cultivation, testing, manufacturing and dispensary license. All complete Missouri cannabis applications received by the department submitted during the application time period will be approved or denied within one hundred fifty (150) days of complete submission. If the number of Missouri cannabis applicants is greater than the number of dispensary licenses available, the DHSS will determine the most suitable candidates by scoring and ranking Missouri cannabis applicants. Pursuant to 19 CSR 30-95.040(1)(B)4, “the department will notify an applicant if an application is incomplete and will specify in the notification what information is missing” from the application. Filing an Appeal to the administrative hearing commission under 19 CSR 30-95.025 requires a petition.

The maximum number of licenses that an organization, or individual can own or have financial interest in is limited to 5 medical dispensary licenses, 3 medical cannabis cultivation licenses, and 3 medical cannabis processor licenses. 

Per Missouri’s medical cannabis regulations, 192 medical cannabis dispensaries were licensed in the first round of applications for medical cannabis facility licenses. However due to Missouri’s application review appeal process multiple licenses were granted in addition to the originally approved 192. At the time of this report, 202 medical cannabis dispensary licenses are listed on Missouri’s DHSS website.
