First time possession convictions are considered a misdemeanor with up to 6 months of incarceration and a $1,000 max fine, subsequent offenses are considered felony charges with up to 3.5 years of incarceration and a $10,000 max fine.

Current Wisconsin Cannabis Legalization efforts

In April 2022, Wisconsin legislators held a public hearing to discuss medical cannabis legalization through SB1034. The bill would legalize cannabis in a limited fashion, not allowing for raw cannabis flower to be provided to patients. While most advocates would like to see a less restrictive legalization effort come forward, the hearing in itself marks a positive milestone towards legalization as in the past getting public hearings for these efforts has been extremely limited. The bill is not currently in circulation and is likely to be voted on later this year.

In 2018 Governor Tony Evers introduced a medical cannabis legalization program as well as a significant decriminalization effort that was removed from the budget by the Joint Finance Committee with an overwhelming majority of Republicans voting to remove it. Reintroducing this topic in 2021, Gov. Evers included both medical and adult-use cannabis measures in his budget proposal followed by several advocates introducing SB545 which also focused on adult-use and medical cannabis legalization. The first introduction of a cannabis legalization related bill in Wisconsin was in 2009, multiple efforts have been made since this time however none have been successful.
