Cannabis cultivation is the process of growing cannabis within a regulated environment for the consumption via a medical or adult-use cannabis program. Generally cultivation refers to the agricultural activities associated with the propagation and growing of cannabis. Cannabis processing is when you manufacture finished cannabis products, packaging of dried flowers or manufacture and package cannabis-based products (i.e. extracts, edibles, and topicals). To be able to produce cannabis and cannabis derived products commercially a specific license is required, requirements depend on the state in which you are locating this business.
The fees for a cannabis cultivation license vary greatly depending on the state in which the facility is to be located. Utah’s non-refundable license application fee is $10,000 and the annual licensing fee is $100,000. Additionally, a $100,000 surety bond was required at the time of applying for a cultivation license to be considered for licensure. Also facility build out costs vary greatly depending on the type of cannabis cultivation facility (indoor, mixed-light green house, outdoor). Depending on the facility type a cultivation facility can range from 2 million to 20 million dollars.
Currently the application process for medical cannabis cultivation is closed and it is unclear when additional licenses will become available. Currently, Utah has 8 medical cannabis cultivators servicing its medical cannabis program.
Every state that has a medical cannabis program has its own laws governing reciprocity in regards to using an out of state medical marijuana card. Some states will allow you to possess your own medical cannabis while others allow you to use your out of state medical card to purchase at their dispensaries. Utah does recognize out of state card holders as long as they meet one of the required conditions to qualify as a medical cannabis patient.
