Currently Texas has a low-THC medical cannabis program with very limited access. The Texas Compassionate Use Program (CUP) allows for physicians to prescribe cannabis oil containing less than .5% THC to qualifying patients. All other forms of cannabis remain illegal in Texas for both medical and adult-use. Cannabis possession convictions of 2 oz or less are considered a misdemeanor with up to 180 days of incarceration and a maximum fine of $2,000.
