Delaware Cannabis Market Overview

In March of 2022, HB305 failed by two votes in the House. This bill would have legalized the possession of up to 1 oz of cannabis for adult use as well as the sale of cannabis from licensed operators. Medical cannabis became legal in Delaware through the passage of the Delaware Medical Marijuana Act in 2011. Despite having a legal medical cannabis market for over 10 years, Delaware patient numbers remain low and the access to medical cannabis is an issue due to the low number of dispensaries (Compassion Care Centers) in the state. Originally Delaware allowed for one dispensary in each county however as of June 2022, seven Compassion Care Centers are licensed in the state.

Although the state formally passed medical cannabis legalization in 2011, the first Compassion Care Center did not receive licensing until 2015. Brian and Kalpna at Cannabis License Experts were very pleasant, informative, and knowledgeable regarding licensing. They helped us fill out all the forms needed and guided us through the entire process. I am sure that without their guidance our application would still be in process, or have been dismissed because of some missing information.

    Business Climate

Overall, the majority of the state has embraced the formal legalization of cannabis in Delaware for medical use. While the state was slow to get its program started, over the last 2 years the program has seen significant growth. There still is a lot of room for improvement to make this a more robust cannabis market which would come through an expansion to the medical program or the adoption of adult-use legalization.

Applying for a Delaware cannabis license and unsure where to start?

Delaware is not currently accepting applications for medical cannabis facility licenses. However it is possible that this process reopens as the program continues to grow. Now is the time to get ahead of the process by defining your business. CLE can develop a preliminary business and feasibility plan to help give you an understanding of your businesses viability within the Delaware cannabis market and give a head start in this process.

Cannabis in Delaware Licenses Financial Requirements

Common for most jurisdictions as a mandatory component of the Delaware cannabis application is the requirement for a minimum amount of liquid cash on hand. This ensures that applicants have the financial wherewithal from the cannabis licensing process through to the initial 2-5 years of operation. Currently due to the low numbers of licenses in the state and the infrastructure needed to supply this industry, the barrier for entry is higher than most states as license holders are expected to cultivate, process, and dispense products.

    Real Estate & Zoning

Consideration for regional and local zoning with regard to allowed proximity to certain business types, schools, and other prohibited areas. Local municipalities cannot ban medical marijuana facilities from locating in their town however they can impose zoning restrictions limiting where the businesses can locate.

At the state level, Delaware only requires that Compassion Care Centers locate 1,000 ft away from preexisting schools. The regulations further stipulate that all centers must adhere to local zoning requirements.
