In March of 2022, HB305 failed by two votes in the House. This bill would have legalized the possession of up to 1 oz of cannabis for adult use as well as the sale of cannabis from licensed operators. Medical cannabis became legal in Delaware through the passage of the Delaware Medical Marijuana Act in 2011. Despite having a legal medical cannabis market for over 10 years, Delaware patient numbers remain low and the access to medical cannabis is an issue due to the low number of dispensaries (Compassion Care Centers) in the state. Originally Delaware allowed for one dispensary in each county however as of June 2022, seven Compassion Care Centers are licensed in the state.

Cannabis in Delaware Licensing Requirements, Timelines, and Approval Processes

Currently only one license type exists for cannabis operators in Delaware, Compassion Care Centers. This license type is authorized to cultivate cannabis, process cannabis products, as well as dispense cannabis and cannabis products to registered patients. Owners of this license type must be residents of Delaware and the business must be a non-profit organization. Although the state formally passed medical cannabis legalization in 2011, the first Compassion Care Center did not receive licensing until 2015. The last application round for licenses was in 2020 when three additional Compassion Care Center licenses were awarded. Applications for Compassion Care Centers in Delaware are currently closed, the state will announce the opening of any future application periods.
