Initial Memo Restricts Sampling to Retail Stores

On October 18, Alberta Gaming, Liquor and Cannabis (AGLC) issued a memo to cannabis businesses stating that cannabis sampling could only occur in retail stores. This notice caused concern among industry members, as it implied new limitations on where sampling could happen.

Correction: Sampling Allowed in Age-Restricted Settings

AGLC now clarifies that the memo was incorrect in parts. Cannabis sampling is still permitted at age-restricted events, such as industry gatherings, not just in retail locations. The recent memo was meant only as a reminder of existing rules rather than a change in policy.

AGLC’s Apology and Updated Communication

An AGLC spokesperson apologized for the confusion caused by the initial memo, saying, “There was an error in the memo that went out on October 18. AGLC apologizes for any frustration this may have caused.” An updated letter has been sent to clarify the original policy, specifying that no changes were made to the rules.

Clarification on Sampling Rules

The updated letter clarifies that cannabis representatives and licensed stores can promote products and provide samples in spaces where only adults are allowed, such as industry events. The original intent of the reminder was to stress that samples cannot be sold or provided directly to the public.

Allowance for Cannabis Licensees and Their Representatives

In response to concerns raised in the industry, AGLC’s new memo also specifies that “cannabis licensees” eligible to receive samples can include employees or representatives acting on behalf of the licensee, like store managers.

Previous Policy Confusion

This is not the first time AGLC has had to correct policy messaging. In September 2023, AGLC reversed a policy change on products containing CBN, explaining that it stemmed from a misunderstanding of federal guidelines.
