On April 17, 2019, Georgia Governor Kemp signed HB324 (the Hope Act) into law allowing qualified patients to possess and have access to low-THC medicinal cannabis oil (limited to 5% THC) in the state. Despite passing this bill and having over 20,000 registered patients, due to litigation over the license application process patients cannot yet access products through licensed dispensaries. It is anticipated the sales will begin in 2023 however this is dependent on the state's ability to properly license cultivators and retailers. However, two bills that are currently in circulation (HB 1425 and SB 609) would basically give this program a new beginning and redo the Georgia cannabis license application process or specifically the application review process. Previously unsuccessful Georgia Cannabis License applicants have cited a lack of transparency in the review and grading process.

Georgia Cannabis License Requirements, Timelines, and Selection

HB324 allows for the licensing of six Georgia cannabis grower licenses to be granted through a merit based Georgia Cannabis License application process. Two Georgia cannabis licenses were designated for Class 1 license types which allow for 100,000 sq ft of grow canopy space, four licenses were designated for Class 2 which allows for 50,000 sq ft of grow canopy space. Both Georgia Cannabis License types allow for the licensee to manufacture low-THC oil to be dispensed through separately licensed pharmacies. The Georgia cannabis production license application period ended on January 27, 2021 however due to litigation and a lack of transparency during the process it is possible that a new process is adopted to review and potentially re-award licenses.
